                            Plan with confidence

Fence permits and property requirements in Olathe

We handle required city permitting for our fence projects.

We review the proposed design and property information before construction, including the conditions that can change the approved layout.

                            When a permit is needed

A standard residential fence at or below the six-foot zoning limit generally does not need a building permit. Permit exemption does not remove the location rules.

How your property affects the plan

Forward front and corner-side fencing has a four-foot limit, must be at least 50% open and has material restrictions. Sight distance, arterial streets and pool barriers require additional planning.

HOA approval is separate. Bring any HOA guidelines and available survey or plat to your estimate. Utility locating does not establish property boundaries.

Most standard residential fences in Olathe do not need a building permit because fences seven feet high or lower are permit-exempt. That does not make them rule-exempt: residential height, front and corner-side openness, approved materials, arterial-street plans, sight distance, property lines, easements and pool-safety requirements still control the design.

Does an Olathe fence need a permit?

A typical residential fence six feet high or lower generally does not require a building permit. Olathe’s building code exempts fences not over seven feet from a building permit, while the zoning code limits ordinary residential fences to six feet. A taller or unusual wall, retaining-wall condition, pool project, floodplain location or other special design may require separate review or approval.

                            Six-foot residential maximum

Fences, walls and hedges in residential districts are generally limited to six feet, measured above the average grade at the property line.

                            Four feet when forward

In a front or corner-side yard beyond the front of the house, a fence is limited to four feet, must be at least 50% open and cannot be chain-link or another metal or wire type.

                            Sight distance controls

A fence cannot obstruct the required intersection sight distance. Inside a regulated sight triangle, objects are generally limited to 24 inches high unless they provide clearance above nine feet.

                            Approved residential materials

Permitted types include brick or stone walls or pillars, chain-link, wood stockade, split rail, wood rail, wrought iron, spaced picket, vinyl imitation or similar decorative material, subject to location limits.

No permit does not mean no planning. Total Home Fence and Deck checks the proposed fence line, height, material, gates, property information, streets, visible utilities and special lot conditions before installation. HOA approval and any separate pool or floodplain approval remain distinct.

Where can a standard residential fence go?

A six-foot privacy fence normally belongs behind the front of the house. A fence extending into the front yard or the street-facing side yard of a corner lot must follow Olathe’s special four-foot, 50%-open and nonmetal requirements. Every layout must stay clear of intersection sight triangles and account for property lines, easements, drainage and private restrictions.

Typical interior lot: a six-foot fence ordinarily stays behind the front of the house. A fence extending forward is limited to four feet, must be at least 50% open and cannot be chain-link or another metal or wire type.

                            Rear yard

A standard residential fence may generally follow the rear property line, subject to easements, drainage, floodplain conditions, arterial-street restrictions and private covenants.

                            Interior side yard

A fence may generally follow an interior side property line. The six-foot residential maximum applies, and the fence must not interfere with utilities, drainage or required access.

                            Front yard

Beyond the front of the home, fencing is limited to four feet, at least 50% open, and cannot use chain-link or any other metal or wire fence.

                            Corner side yard

The same forward-yard restrictions apply on the street-facing side beyond the front of the house. Intersection and driveway visibility can require an even lower or relocated fence.

Corner lots need a visibility check

Olathe does not use one universal corner-lot fence setback in the fence section. Instead, the street-facing yard restrictions and the mapped sight-distance triangles control the layout. Because sight triangles are determined under city design criteria, the safe fence line cannot be established from the curb or an old fence alone.

*The recorded plat, survey, street classification, easements, utilities, drainage, floodplain status, zoning, sight-distance requirements and private restrictions can change the approved line. An address-specific review is necessary.

                            Easements, drainage, arterials and utilities

Arterial streets: Residential fences, walls and hedges are allowed along arterials only when approved as part of a master fence or screening plan. A private replacement should not assume that an existing subdivision fence establishes an individually usable line.

Easements and utilities: A fence may be physically possible inside some easements, but utilities and easement holders retain access rights and may remove or damage it. Kansas 811 marks participating public utilities; it does not mark property lines, sprinklers, invisible dog fences or every private line.

Drainage and floodplain: Fencing cannot unlawfully obstruct drainage. Floodplain and floodway properties require separate review because a fence can be treated as an encroachment and may affect water flow.

Special situations need an additional check

Swimming pools, spas and hot tubs

A fence used as an Olathe pool or spa barrier must satisfy both the zoning rules and the adopted swimming-pool safety code. For pools serving homes governed by the residential code:

                            • The top of the barrier must be at least 48 inches above grade, measured on the side facing away from the water.
                            • The bottom clearance is limited to 2 inches over grass or gravel and 4 inches over a solid surface such as concrete.
                            • When mounted on an above-ground pool or spa structure, the gap between the structure and barrier cannot exceed 4 inches.
                            • Openings, horizontal-member placement and decorative cutouts must restrict passage and climbing as required by the adopted pool code.
                            • Pedestrian gates must open away from the pool and be self-closing and self-latching; access gates must be capable of being secured.
                            • If the house, a powered safety cover or another feature forms part of the barrier, that design requires project-specific code review.

Public and semi-public pools have stricter six-foot barrier requirements. Because these are life-safety provisions, Total Home Fence and Deck confirms the current requirements for the actual pool, spa, gate and yard layout rather than assuming a standard fence qualifies.

                            Retaining walls

A fence above or near a retaining wall changes how effective height, fall protection and structural loading are evaluated. Retaining walls over three feet in applicable commercial or industrial settings require fencing, and engineered or building review may apply in other conditions.

                            Homes associations and deed restrictions

Private restrictions may be stricter about style, material, color, height and location. The absence of a city building permit does not replace HOA approval, and HOA approval does not override city requirements.

How Total Home Fence and Deck helps

We review the fence style, height, gates and site conditions before construction, including front and corner-side yards, streets, property lines, utilities, easements, drainage, floodplain conditions, sight-distance areas and homes-association requirements. We offer wood, aluminum, vinyl and steel fencing where the selected style meets Olathe’s location and material rules, and our wood gates use three-inch metal hinge posts to better handle long-term gate stress.

                            Olathe fence permit FAQ

Does a standard residential fence need a building permit?

Usually no. Olathe exempts fences not over seven feet from a building permit, and the ordinary residential zoning maximum is six feet. All zoning, visibility, pool, easement and HOA requirements still apply.

How tall can a residential fence be?

Generally six feet. In a front or corner-side yard beyond the front of the house, the maximum is four feet and the fence must be at least 50% open.

Can an aluminum or steel fence go in front of the house?

Not under the ordinary forward-yard exception. Olathe prohibits chain-link and other metal or wire fencing in the front or corner-side area beyond the front of the house.

Is there one standard corner-lot setback?

No single footage in the fence rule applies to every corner lot. The front/corner-side yard rule, street classification, property information and required sight-distance triangles must be checked for the address.

Can a fence run along an arterial street?

Only when it is part of an approved master fence or screening plan. Existing subdivision fencing does not automatically authorize a private fence in the same area.

Can a fence be installed in an easement?

It depends on the recorded easement and the holder’s rights. Access, drainage, removal and reconstruction risks must be evaluated before placing a fence there.

Does Kansas 811 mark property lines?

No. Utility locating and boundary surveying are different services.

                            Official references

This page provides general educational information, not an address-specific zoning, boundary or code determination. Requirements can change. The city, utilities, homes association and project professionals must confirm current requirements for the property and design.

Brian, Nolan, Rob and crew were great to work with on my project. They did a fantastic job on my deck and fence installation, communicating and walking through each step with me. Their crew did a great job picking up after themselves and keeping things organized. I couldn’t be happier with my new deck and fence.

Rob was a very nice man to deal with. He worked with what my reasonable expectations were, he is the kind of guy who doesn’t count the workload, but it’s just all about customer satisfaction. I think these times nowadays it is hard to get that kind of workers, and I appreciate him for displaying that demeanor. I wanted to share that at least as a token of my appreciation and gratitude for the lovely composite deck he made for me and my family in our backyard. Thank you ROB!

The Royal crew did a great job installing our wood fence. They completed work on time, paid attention to the small details and completely cleaned up and removed all debris when finished. A minor issue with a gate latch was quickly and completely resolved.
